Terms of Service
These Terms of Service (“Terms”) govern your use of the RainStorm macOS app (“RainStorm,” “the app”). By downloading, installing, or using RainStorm, you agree to these Terms. If you do not agree, do not use RainStorm.
1. Eligibility
You may use RainStorm only if you can form a binding agreement under applicable law. If you are using RainStorm on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. License to Use RainStorm
Subject to these Terms, RainStorm grants you a limited, non-exclusive, non-transferable, revocable license to use the app on Apple devices you own or control, in accordance with applicable App Store terms and Apple platform rules.
RainStorm is licensed, not sold.
3. App Features and Permissions
RainStorm is a local-first menu bar app that provides ambient rain visuals and audio. Some optional features may request system permissions, such as camera/microphone access for meeting detection and user-selected file access for support log export.
RainStorm uses these permissions only for the feature purpose described in-app.
4. Acceptable Use
You agree not to:
- use RainStorm in violation of applicable law
- interfere with or disrupt the app's operation
- attempt to gain unauthorized access to systems or data
- remove or alter proprietary notices
- reverse engineer, decompile, or disassemble the app except where such restriction is prohibited by law
5. Intellectual Property
RainStorm and all related content, branding, software, design elements, and associated intellectual property are owned by RainStorm or its licensors and are protected by applicable law.
Except for the license granted above, no rights are granted to you.
6. Feedback
If you submit ideas, suggestions, or feedback about RainStorm, you grant RainStorm a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use that feedback for any purpose, without compensation to you.
7. Privacy
Your use of RainStorm is also governed by the RainStorm Privacy Policy.
8. Third-Party Platforms and Services
RainStorm may be distributed through third-party platforms such as the Apple App Store. Those platforms may have their own terms and policies that also apply.
These Terms are between you and RainStorm, not Apple, except where applicable law or platform terms provide otherwise.
9. Disclaimer of Warranties
To the maximum extent permitted by law, RainStorm is provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
RainStorm does not warrant that the app will be uninterrupted, error-free, or available at all times.
10. Limitation of Liability
To the maximum extent permitted by law, RainStorm will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, goodwill, or business interruption, arising out of or related to your use of the app.
To the maximum extent permitted by law, RainStorm's total liability for all claims related to the app will not exceed the amount you paid for RainStorm (if any) in the 12 months before the event giving rise to the claim.
11. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless RainStorm from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the app, your violation of these Terms, or your violation of applicable law.
12. Updates, Changes, and Availability
RainStorm may update, modify, suspend, or discontinue features at any time. Some updates may be required for continued use.
RainStorm may also update these Terms from time to time. When updates are made, RainStorm will update the Effective date above. Your continued use of the app after an update means you accept the revised Terms.
13. Termination
These Terms remain in effect until terminated. RainStorm may suspend or terminate your license if you materially violate these Terms. You may terminate these Terms at any time by stopping use of RainStorm and removing the app from your devices.
Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute-related provisions) will survive.
14. Governing Law and Disputes
These Terms are governed by applicable law, without regard to conflict-of-law principles, except where mandatory law requires otherwise. Any dispute will be resolved in a court of competent jurisdiction unless applicable law requires a different process.
